APPLICANT REQUESTS THAT: 

 

His bad conduct discharge be upgraded to an honorable discharge 
based on 4 years and 8 months of service.

APPLICANT CONTENDS THAT: 

 

A similar appeal was considered and denied by the Board on 
5 June 2012. For an accounting of the facts and circumstances 
surrounding the applicant’s bad conduct discharge and the 
rationale of the earlier decision by the Board, see the Record 
of Proceedings (ROP) at Exhibit G. 

 

On 15 June 2012 the applicant submitted a request for 
reconsideration. In support of his request, he submits a DD 
Form 293, Application for Review of Discharge from the Armed 
Force of the United States and four witness statements.

THE BOARD CONCLUDES THAT: 

 

In earlier findings, the Board determined there was insufficient 
evidence to warrant any corrective action. After thoroughly 
reviewing the additional documentation submitted in support of 
his appeal and the evidence of record, we do not believe the 
applicant has overcome the rationale expressed in our previous 
decision. Therefore, in view of the above, and in the absence 
of evidence to the contrary, we find no basis upon which to 
recommend favorable reconsideration of the applicant’s request.

THE BOARD DETERMINES THAT: 


 

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the

with this application.
